Удивительно, что в соглашении постоянно (если не ошибаюсь, шестнадцать раз) повторяется одна и та же формула: "The Islamic Emirate of Afghanistan which is not recognized by the United States as a state and is known as the Taliban".
Причем в конце записано - мол, "the United States and the Islamic Emirate of Afghanistan which is not recognized by the United States as a state and is known as the Taliban seek positive relations with each other"
Обязательства, которые взяли на себя талибы:
1 - <...> will not allow any of its members, other individuals or groups, including al-Qa’ida, to use the soil of Afghanistan to threaten the security of the United States and its allies.
2 - <...> will send a clear message that those who pose a threat to the security of the United States and its allies have no place in Afghanistan, and will instruct [its] members not to cooperate with groups or individuals threatening the security of the United States and its allies.
3 - <...> will prevent any group or individual in Afghanistan from threatening the security of the United States and its allies, and will prevent them from recruiting, training, and fundraising and will not host them in accordance with the commitments in this agreement.
4 - <...> is committed to deal with those seeking asylum or residence in Afghanistan according to international migration law and the commitments of this agreement, so that such persons do not pose a threat to the security of the United States and its allies.
5 - <...> will not provide visas, passports, travel permits, or other legal documents to those who pose a threat to the security of the United States and its allies to enter Afghanistan.
Если я правильно понимаю, то пункт 5 явлояется де-факто признанием законности паспортов, виз и прочих документов, которые выписывает Талибан.

Если я правильно понимаю, то пункт 5 явлояется де-факто признанием законности паспортов, виз и прочих документов, которые выписывает Талибан.

Date: 2020-02-29 09:25 pm (UTC)Что есть такая организация - это просто факт, для этого не требуется отдельное признание. Факт существования такой организации подтверждается, например, включением ее специальный список - https://www.state.gov/foreign-terrorist-organizations
Признание этой организации как активного участника конфликта, могущего быть стороной в мирном соглашении - подтверждается фактом переговоров, которые ведутся уже очень давно.
А вот признание того, что организация может выпускать паспорта и т.д., которые в определенных случаях могут рассматриваться как документы, достаточные для международных поездок - это, как мне кажется, очень неожиданно.

Date: 2020-02-29 11:00 pm (UTC)Вообще это не означает признания талибановских документов собственно Америкой. В п. 5 может быть просто проявлена забота о том, что какие-то страны могут (сейчас или в будущем) признавать документы выданные Талибаном. И, соответственно, враги США (назову их для краткости так) смогут вести какую-то деятельность не на территории Талибана пользуясь бумагами выданными Талибаном.
Однако реальная ситуация может быть такова, что, пока талибановские документы не станут принимать "агенты" американского правительства, практически пользоваться этими документами можно только на территории Талибана; и наоборот — как только США признают эти документы, ими станет возможно пользоваться много где. В таком случае пункт 5 может быть действительно подготовкой к "легализации" Талибана если не во всех, то хоть каких-то отношениях.
Как на самом деле, я не зна.
