borislvinДавно собирался написать детальный разбор решения Верховного суда по делу Grutter v. Bollinger (http://laws.findlaw.com/us/000/02-241.html) - это еще в прошлом году было громкое дело о допустимости расовых преференций при приеме в государственный университет. Видимо, уже и не соберусь. Если в двух словах, то решение суда я считаю позорнейшим, а обоснование, написанное О'Коннор - полностью лишенным логики.

Мне оно кажется образцовым по логике, ясности изложения, эрудиции и тонкому остроумию.
Особенно полезно его наблюдение касательно традиционных отсылок "другие тоже так делают". Это наблюдение настолько четко и ясно, что его стоит специально выделить:
While legal education at a public university may be good policy or otherwise laudable, it is obviously not a pressing public necessity when the correct legal standard is applied. Additionally, circumstantial evidence as to whether a state activity is of pressing public necessity can be obtained by asking whether all States feel compelled to engage in that activity. Evidence that States, in general, engage in a certain activity by no means demonstrates that the activity constitutes a pressing public necessity, given the expansive role of government in today's society. The fact that some fraction of the States reject a particular enterprise, however, creates a presumption that the enterprise itself is not a compelling state interest.
